Workers comp insurance requirements in Wisconsin

In Wisconsin, the following employers must have workers’ compensation: 

– Employers that have one or more part-time or full-time employees with a total gross wage of $500.
– Farmers who employ 6 or more people on any 20 days of the calendar year. Some farmers’ relatives may not be considered employees.
– Employers with three or more full-time or part-time employees.
– Part-time employees must carry worker’s compensation insurance regardless of their schedule.
– Family members of the employees must also have worker’s comp (except for certain relatives of a farmer).
– Worker’s comp insurance requirements cover employees even if they are minors.
– Under Wisconsin laws, corporate officers are regarded as employees.
 

Workers comp insurance exemptions in Wisconsin

– Any employee whose job does not involve the employer’s trade, business, profession, or occupation.
– Domestic workers.
– Employees of Native American tribal enterprises, including casinos, unless the tribe chooses to waive sovereign immunity and voluntarily become subject to the Act.
– Limited liability company members, partners, and sole proprietors.
– Members of certain religious sects who are qualified and certified.
– Some farm workers (certain relatives of a farmer).
– Some real estate brokers, agents, and salespeople.
– Volunteers from non-profit organizations who receive no more than $10 per week in salary or in-kind compensation.
 

Penalties for not having workers comp insurance exemptions in Wisconsin 

Employers that do not comply may face one or more of the following consequences: 

– Fines for double the insurance premiums the employer should have paid during the uninsured period, or $750, whichever is greater.
– Under certain conditions, the employer may be subject to a $100 penalty for each day they are uninsured, up to seven days.
– The company could be closed with all operations suspended.
– The employer will be personally liable for uninsured benefit claims made by your injured employees.
